These Terms and Conditions (“Terms”) govern your use of the Control Tower software (“Software”), a trading facilitation tool developed by Parametric Trading (“we”, “us”, “our”). By accessing or using the Software, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Software.
Use License
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, license to use the Software for both your personal and commercial purposes.
No Claims Policy
You acknowledge and agree that:
- Your use of the Software and any trading activities conducted through it are at your sole risk.
- Under no circumstances shall we be liable for any losses, damages, or harm resulting from your trading activities, whether direct or indirect, incidental, consequential, or any other type of damage.
- This No Claims Policy applies to losses incurred due to the failure of the Software, bugs within the Software, or any issues arising within the trading ecosystem that involves the use of the Software.
- You will not hold us responsible or liable for any losses or damages resulting from the use of the Software.
No Financial Services
- The Software is provided “as is” without any representations or warranties, express or implied. We do not offer financial advice, trading advice, or any other form of investment advice.
- The purpose of the Software is solely to facilitate trading activities. You are responsible for conducting your own research and making your own trading decisions.
Intellectual Property
The Software and all intellectual property rights therein are owned by or licensed to Parametric Trading. You are granted no rights in or to the Software other than the license to use specified herein.
Amendments
We reserve the right to modify these Terms at any time. Your continued use of the Software following any such modifications constitutes your acceptance of the new Terms.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.
